The former NBA star, 36, was found at the brothel in October and promptly taken to the hospital.
Nye County District Attorney Angela Bello said on Monday that the sheriff's office submitted the charge of unlawful use of cocaine or being under the influence of a controlled substance last week.

A state prosecutor is considering filing the charge against Odom, according to PEOPLE.
A statement from District Attorney Bello said:

'The Nye County Sheriff's Office has now asked the Nye County District Attorney's Office to review a request for prosecution against Lamar Odom for Use of, or Under the Influence of, a Controlled Substance.

The D.A.'s office will take the time needed to appropriately review that request, along with all evidence that might support that request, in order to reach a just conclusion regarding whether to advance charges.'
Authorities investigating the possible cocaine overdose by Odom also got a warrant to take a blood sample while he was hospitalized in critical condition after a weekend at the brothel.
